The present document specifies the rules of processing and protecting the personal data of both potential and current business partners of Amwin Sp. z o. o., hereinafter referred to as Amwin.

1. Clause for customers

The purpose of processing your personal data is to execute the concluded agreement, pursuant to Art. 6 section 1 item b) of the GDPR. Your data shall be processed to the following extent:

  • to execute the provisions of the agreement until its cessation; legal basis: Art. 6(1)(b) of the GDPR (processing is necessary for the performance of a contract to which the data subject is party, or in order to take steps at the request of the data subject prior to entering into a contract);
  • to enable the performance of a legal obligation of the Data Controller; legal basis: Art 6(1)(c) of the GDPR (e.g. drafting and storing accounting documents, responding to complaints, compliance with obligations arising from the rights of data subjects, cooperation with state administration authorities);
  • to pursue the parties’ legitimate interests; legal basis: Art. 6(1)(f) of the GDPR (the processing is necessary to achieve goals arising from the Controller’s legitimate interests);
    to communicate with the goal of facilitating work; legal basis: Art. 6(1)(a) of the GDPR, as well as for analytical and statistical purposes for the duration of the agreement and the period of pursuing any mutual claims.

PERSONAL DATA RECIPIENT CATEGORIES: 

  • personal data may be transferred to entities supporting our business processes, e.g. entities rendering mailing or courier services, accounting services, tax services, legal services.
  • personal data may be disclosed for the purpose of audits, as part of counselling services, ensuring compliance and owner supervision;
    be advised that in cases subject to other legal provisions and in line with the methods specified in these provisions, personal data may be transferred to authorised state administration organs;
  • personal data may be processed with the use of external IT infrastructure belonging to hosting service providers, as well as being transferred to entities operating the Data Controller’s ICT systems or providing the Data Controller with IT tools, which are compliant with the GDPR with regard to systems security;
    The Data Controller declares that every case of data being made available or transferred to be processed is based on the consent of the data subject, a personal data processing agreement or a legal obligation.

In relation to the processing of your personal data, you have the right to access these data (Art. 15 of the GDPR) and the right to demand their correction (Art. 16 of the GDPR), deletion (Art. 17 of the GDPR) or to restrict their processing (Art. 18 of the GDPR), as well as the right to object to these data being processed (Art. 21 of the GDPR) and the right to transfer these data (Art. 20 of the GDPR).

If your personal data is being processed pursuant to Art. 6(1)(a) or Art. 9(2)(a) of the GDPR, you have the right to withdraw your consent at any moment without impacting the legality of the processing which occurred based on your consent before its withdrawal.

In addition, you have the right to submit a complaint to the Polish personal data protection supervisory body (President of the Personal Data Protection Office).

Your personal data shall be retained for a period required to fulfil the processing purposes of the Controller, or for the period necessary to secure the pursuit of or defend against claims, or to fulfil legal obligations.

Due to the fact that we process your personal data, you have the right to:

  • demand access to your personal data.
  • demand that your personal data be corrected.
  • demand that your personal data be erased or that their processing be restricted.
  • object to the processing of your data.
  • submit a complaint to the relevant supervisory body (President of the Personal Data Protection Office).

Providing personal data is voluntary, though it is necessary for establishing any commercial partnerships with your employer. Without your data, it will be impossible for us to work with you in any capacity.

PURPOSE AND LEGAL BASIS FOR PROCESSING PERSONAL DATA

For the purpose of conducting the recruitment process, based on the right of the employer resulting from Art. 221 of the Polish Labour Code, the personal data processed shall be limited to: your name and surname, parent names, date of birth, residence address, mailing address, education and employment record. The legal basis for the processing of the above data is a legal obligation (Art. 6(1)(c) of the GDPR).
For the purpose of recruitment, based on your consent to the processing of your personal data, i.e. personal data other than those specified in the point above, made available by you in your resume, recruitment form, cover letter and other documents. The basis for the processing in this case is the above-mentioned consent (Art. 6(1)(a) of the GDPR).
For the purpose of pursuing a legitimate interest of the Data Controller regarding your personal data acquired in the course of the recruitment process in relation to assessing your skills and abilities required to perform work in the advertised position. The basis for the processing is our legitimate interest (Art. 6(1)(f) of the GDPR).
For the purpose of pursuing the Data Controller’s legitimate interest should a legal need arise to prove facts and that legal obligations have been fulfilled (Art. 6(1)(f) of the GDPR).
For the purpose of recruitment, based on your consent to the processing of the personal data made available by you in your CV, recruitment form, cover letter and other documents. The basis for the processing is your consent (Art. 6(1)(a) of the GDPR).

DATA RETENTION PERIOD

Your data collected in the course of the current recruitment process shall be retained until the recruitment process is complete.

If you consent to your personal data being used for the purposes of future recruitment processes, your personal data shall be used for the period of 9 months.

Rights of data subjects

You have the right to:

  • access your data and receive a copy of them.
  • correct your personal data.
  • restrict the processing of your personal data.
  • delete your personal data.
  • submit a complaint to the President of the Data Protection Office (to the address of the Data Protection Office – ul. Stawki 2, 00-193 Warszawa).

DATA PROVISION REQUIREMENT NOTICE

Providing your personal data to the extent resulting from Article 221 of the Polish Labour Code is necessary for you to participate in the recruitment process. Providing personal data is voluntary.

5. Cookie clause

AUTOMATIC DATA COLLECTION

We would like to inform you that the website’s system logs contain data on the IP addresses and end devices of users browsing the website, as well as data on the time of browsing and other usage data regarding users’ activity on the website. The above-mentioned data shall be processed for technical reasons for the purpose of adapting the website to user needs and to collect general statistical data on the functioning of the website.

www.amwin.pl uses cookies (small text files stored on your device during browsing and using web sites or other online services). Amwin uses cookies to manage user requests and agreements, configure the website, carry out processes necessary for the website to function properly, ensure website security, deliver multimedia content, collect general and anonymous statistical data via Google Analytics tools, implement interactive features for the purpose of promoting the website in social media (Facebook.com) and profile advertisement content to be in line with the interests of the website’s users.

Users can delete cookie files at any moment using the appropriate browser tools. Restricting cookie use may impact certain features of the website.

Amwin informs that the data of users who order a telephone call from the website, the Callpage application, are stored in the Amazon cloud. These data are secured in line with all telecommunication standards, i.e. using the 256-bit SSL A+ grade protocol.

FINAL PROVISIONS

Amwin declares that it shall use its best efforts to ensure that Customer data is processed with high-level security. All events which have an impact on personal data processing security should be reported by email to or in writing to the address of the Amwin headquarters.
